What this form is for
Under the Condominium Act, 1998 and Ontario Regulation 48/01, owners, purchasers, and mortgagees (or their authorized agents) must use the mandatory Request for Records form to ask a condominium corporation for its records. Using the exact prescribed form is required — a corporation can decline a request that does not use it.
When to use it
- You want to review or obtain copies of core records such as the declaration, by-laws and rules, budget, financial statements, auditor’s report, reserve fund plan, meeting minutes, or the record of owners and mortgagees.
- You are requesting non-core records (subject to reasonable fees).
- You are a purchaser or mortgagee entitled to review records before or during a transaction.
What happens next
The corporation has 30 days to respond using the mandatory Board’s Response to Request for Records form. It must state, for each record, whether access or a copy will be provided, any applicable fee, and — if it refuses — the provision of the Act that allows the refusal.
